Miguel Cabrera gets driver's license back

"Miguel Cabrera's driver's license was reinstated when an administrator with the Florida Department of Highway Safety and Motor Vehicles ruled Friday that the arresting officer did not have probable cause to believe that Cabrera was driving under the influence of alcohol.

The Detroit Tigers slugger's license was initially suspended because he refused to take a breath test Feb. 16 as he was being arrested on a rural highway in Ft. Pierce, Fla. Michael Kessler, a Ft. Pierce attorney representing Cabrera, argued during an administrative hearing Wednesday that Florida law states a driver has to be in control of an operable vehicle to be required to take a breath test.

Kessler also argued that although the St. Lucie County Sheriff's deputies who arrested Cabrera saw him drinking scotch in his Land Rover that had broken down on State Road 70, they didn't see him drive it there.

"While that may be in violation of a number of laws," Kessler told Lorinna Metro, operations analyst for the Florida Department of Highway Safety and Motor Vehicles, "it is not a violation of state DUI laws."

Metro agreed and signed an order to remove the suspension. The St. Lucie County Sheriff's Office has 30 days to appeal."
