Benson talks about his appeal

"Cedric Benson ran for 64 yards against San Francisco on Sunday. If it is his last game until Oct. 30 at Seattle remains to be seen.

Benson will have a hearing in New York on Tuesday to appeal his three-game suspension. Following the 13-8 loss to the Niners, the Bengals running back said he had filed an unfair labor practice charge with the National Labor Relations Board against the NFL Players Association.

While Benson did know about his suspension before the Sept. 11 opener at Cleveland, the seventh-year running back said he did not know about an Aug. 4 agreement between

NFL general counsel Jeff Pash and NFLPA executive director DeMaurice Smith allowing the suspension of eight players, including Benson, who Commissioner Roger Goodell considered as repeat offenders for offenses during the lockout related to the personal conduct policy.

"There were some things in the CBA that we were not made aware of, which is really no surprise. That kind of falls on the PA (players association)," Benson said. You would think they're here to support you and have your back, that's what a union does. I guess in my case it's different."
